Terms of Use
Effective date: 30 October 2026 · Last updated: 30 October 2026
1. Agreement to these Terms
These Terms of Use (“Terms”) govern your access to and use of the Emelo Digital marketing website and related public content. By accessing or using the site, you agree to these Terms. If you do not agree, do not use the site.
These Terms are a website-use agreement. They do not replace a signed proposal, statement of work, master services agreement, or other contract for paid services. If you engage Emelo Digital for a project, that engagement will be governed by the commercial documents we execute with you.
2. Who we are
Emelo Digital is a digital studio that helps service-based businesses with brand strategy and identity, website design and build, client intake and workflow setup, practical AI-assisted business infrastructure, and launch and growth support. Emelo Digital operates within the Emelo Group family of businesses. Formal legal-entity details for contracting will appear in proposals and invoices and may be added to this page once confirmed for public listing.
Primary public contact for the website: hello@emelodigital.com.
3. Purpose of the website
The website is provided to:
- describe Emelo Digital’s services and working approach;
- share educational and marketing information about our work; and
- allow prospective clients to request a discovery conversation or send an inquiry.
Website content is for general information. It is not legal, financial, medical, or other regulated professional advice, and it is not a guarantee of outcomes for any particular business.
4. Eligibility and acceptable use
The site is intended for business and professional users. You agree not to misuse the site, including by:
- attempting to disrupt, probe, or compromise security or availability;
- submitting spam, malware, deceptive content, or automated bulk inquiries;
- impersonating another person or misrepresenting your affiliation;
- scraping or harvesting content or contact details at scale without our written permission; or
- using the site in violation of applicable law.
We may rate-limit, block, or ignore submissions that appear abusive, and we may suspend access where reasonably necessary to protect the site or our users.
5. Contact form and communications
If you submit the contact form or email us, you represent that the information you provide is accurate to the best of your knowledge and that you have authority to share it. You agree that we may process that information as described in our Privacy Policy.
Submitting an inquiry or requesting a discovery call does not create a client relationship, does not reserve capacity, and does not oblige Emelo Digital to accept any engagement. We aim to reply within a few business days, but response times can vary with volume and complexity.
Automated acknowledgements confirm receipt only. They are not a proposal, quotation, or acceptance of work.
6. Intellectual property
Unless otherwise stated, the website’s design, text, graphics, logos, and other materials are owned by Emelo Digital / Emelo Group or used under licence. You may view and temporarily download pages for your personal or internal business evaluation of our services. You may not copy, modify, distribute, sell, or exploit site content for commercial purposes without prior written permission, except for ordinary quoting of short excerpts with attribution in professional communications.
Service deliverables created under a paid engagement are governed by the ownership and licence terms in that engagement’s contract—not by these website Terms alone.
7. Third-party content and tools
The site may reference third-party tools, platforms, or link to external sites. We do not control those third parties and are not responsible for their availability, content, security, or practices. Any use of third-party products is between you and the third party.
8. AI-related statements
Where we describe AI-assisted services, we mean practical tooling used with human oversight as described on the site. Website statements about AI are informational. Specific AI workflows, model vendors, and data-handling commitments for a client project will be defined in the relevant commercial documents.
9. Disclaimers
THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR COMPLETENESS OF MARKETING CONTENT, EXCEPT WHERE SUCH DISCLAIMERS ARE NOT ALLOWED.
We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, though we take reasonable steps to keep it secure and available.
10. Limitation of liability
To the maximum extent permitted by applicable law, Emelo Digital and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the website or reliance on its content.
To the maximum extent permitted by law, our aggregate liability arising out of website use under these Terms will not exceed one hundred US dollars (USD $100) or the minimum amount required by mandatory law, whichever is higher. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including liability for fraud or personal injury caused by negligence where such exclusion is prohibited).
Liability for paid client work is governed exclusively by the client contract for that work.
11. Indemnity
You agree to indemnify and hold harmless Emelo Digital and its affiliates from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the site, your violation of these Terms, or your infringement of another party’s rights in connection with your use of the site, except to the extent caused by our wilful misconduct.
12. Governing law and disputes
Governing law, venue, and dispute-resolution method for these website Terms will be confirmed by Emelo Digital’s counsel based on the operating entity and primary place of business (to be inserted before final publication). Until that confirmation, disputes about website use should first be raised in writing to hello@emelodigital.com so we can attempt an informal resolution.
13. Changes
We may revise these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continued use of the site after changes take effect constitutes acceptance of the revised Terms, except where mandatory law requires a different process.
